DMCA Policy

VibeBot respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act (DMCA) Policy outlines our procedures for addressing copyright infringement claims on our platform.
In accordance with the DMCA (17 U.S.C. § 512), we will respond expeditiously to valid notices of alleged copyright infringement.
1. Filing a DMCA Copyright Infringement Notice
If you believe that content on VibeBot infringes your copyright, you may submit a written notification pursuant to the DMCA. To be effective, your notice must include the following information:
Required Elements:
1. Physical or Electronic Signature
A physical or electronic signature of the copyright owner or person authorized to act on their behalf.
2. Identification of Copyrighted Work
Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, provide a representative list.
3. Identification of Infringing Material
Identification of the material claimed to be infringing, with sufficient detail to locate it on VibeBot (e.g., bot name, bot ID, URL, specific configuration).
4. Contact Information
Your contact information, including name, address, telephone number, and email address.
5. Good Faith Statement
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. Accuracy Statement
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Warning: Filing a false or fraudulent DMCA notice may result in civil liability for damages, including costs and attorney's fees, under Section 512(f) of the DMCA.
2. How to Submit a DMCA Notice
Send your complete DMCA notice to our designated Copyright Agent:

Please allow 1-2 business days for processing. You will receive confirmation of receipt.
3. Our Response to DMCA Notices
Upon receiving a valid DMCA notice, we will:
Remove or Disable Access
Promptly remove or disable access to the allegedly infringing material.
Notify the User
Inform the user who posted the content that we have removed or disabled access to it.
Provide Counter-Notice Information
Provide the user with information about filing a counter-notice if they believe the removal was erroneous.
Document the Notice
Maintain records of DMCA notices and our responses as required by law.
4. Filing a DMCA Counter-Notice
If you believe your content was removed or disabled by mistake or misidentification, you may file a counter-notice. To be effective, your counter-notice must include:

1. Physical or Electronic Signature
Your physical or electronic signature.
2. Identification of Material
Identification of the material that was removed and its location before removal.
3. Good Faith Statement
A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Contact Information and Consent
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of California if outside the U.S.), and that you will accept service of process from the person who filed the original DMCA notice.

5. Our Response to Counter-Notices
Upon receiving a valid counter-notice, we will:
- Forward the counter-notice to the original complainant who filed the DMCA notice
- Inform the complainant that we will restore the removed content in 10-14 business days unless they file a court action seeking an injunction against the user
- Restore the content after the waiting period expires, unless we receive notice that legal action has been filed
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, VibeBot has adopted a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers.
We may also, at our sole discretion, limit access to VibeBot and/or terminate the accounts of any users who infringe intellectual property rights, whether or not there is any repeat infringement.
7. User Responsibilities
As a VibeBot user, you are responsible for ensuring that your bots and content do not infringe on the intellectual property rights of others. This includes:
- Bot names, logos, and branding that don't infringe trademarks
- Custom code and scripts that respect software licenses
- Images, audio, and media files that you own or have permission to use
- Text content and responses that don't plagiarize copyrighted material
- Integration with third-party services in compliance with their terms
8. Consequences of Misrepresentation
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that:
- Material or activity is infringing, or
- Material or activity was removed or disabled by mistake or misidentification
shall be liable for any damages, including costs and attorney's fees, incurred by the alleged infringer, copyright owner, or service provider who is injured by such misrepresentation.
9. Limitations of This Policy
This DMCA Policy applies only to copyright infringement claims under U.S. law. For other intellectual property concerns:

- Patent Issues: Contact support@vibebot.gg with documentation of the patent and alleged infringement
- Other IP Concerns: Contact support@vibebot.gg with relevant details
10. DMCA Safe Harbor
VibeBot qualifies as a service provider under the DMCA's safe harbor provisions (17 U.S.C. § 512(c)). We do not actively monitor user-generated content for copyright infringement but respond promptly to valid DMCA notices.
We do not have actual knowledge of infringing activity on our platform unless we receive a proper DMCA notice. We do not receive financial benefit directly attributable to infringing activity.
11. Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to this page. The "Last Updated" date at the top indicates the most recent revision.
