Terms of Service

By creating an account or using VibeBot, you represent that you are at least 13 years old (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms.

If you are using VibeBot on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

VibeBot is a Software-as-a-Service (SaaS) platform that enables users to create, customize, and deploy Discord bots. Our Service includes:

• Discord bot creation and customization tools
• Cloud hosting and deployment infrastructure via Railway
• Bot management dashboard and analytics
• Integration with Discord's API and services
• Support and documentation resources

3.1 Discord Authentication: You must authenticate using Discord OAuth to create an account. By connecting your Discord account, you authorize us to access certain Discord profile information as outlined in our Privacy Policy.

3.2 Account Security: You are responsible for maintaining the security of your Discord account and any activity that occurs under your VibeBot account. You must immediately notify us at support@vibebot.gg of any unauthorized access or security breach.

3.3 Accurate Information: You agree to provide accurate and complete information during registration and to keep this information updated.

4.1 Subscription Tiers: VibeBot offers multiple subscription tiers (Free, Starter, Pro) with varying features and usage limits. Current pricing and features are available at vibebot.gg/pricing.

4.2 Payment Processing: Payments are processed through Stripe. By subscribing to a paid plan, you agree to Stripe's terms and authorize recurring charges to your payment method.

4.3 Billing Cycle: Subscriptions are billed on a recurring basis (monthly or annually) as selected at purchase. Your subscription will automatically renew unless cancelled before the renewal date.

4.4 Cancellation: You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. You will retain access to paid features until the end of your current billing cycle.

4.5 Wallet Top-Ups: Generation credits purchased as wallet top-ups are non-refundable and non-transferable. Top-up credits do not expire but cannot be converted back to cash or credit.

4.6 Price Changes: We reserve the right to modify pricing with 30 days' notice. Price changes will not affect your current billing cycle but will apply upon renewal.

4.7 No Refunds: All purchases are final. We do not provide refunds for subscription plans, wallet top-ups, or any other purchases. By making a purchase, you acknowledge that you are not entitled to a refund for any reason, including unused subscription time or generation credits.

You agree not to use VibeBot to create bots that:

• Violate Discord's Terms of Service or Community Guidelines
• Engage in spam, harassment, or abusive behavior
• Distribute malware, viruses, or malicious code
• Infringe on intellectual property rights
• Impersonate others or misrepresent affiliation
• Collect user data without proper consent
• Engage in illegal activities or promote violence
• Attempt to circumvent usage limits or security measures
• Scrape, mine, or harvest data from Discord without authorization
• Engage in cryptocurrency mining or resource exploitation

6.1 Your Content: You retain ownership of all content, configurations, and bot scripts you create using VibeBot. By using our Service, you grant us a limited license to host, store, and process your content solely to provide the Service.

6.2 Our Intellectual Property: VibeBot's platform, code, design, logos, and trademarks are owned by VibeBot and protected by copyright and trademark laws. You may not copy, modify, or reverse engineer our Service.

6.3 User Responsibility: You are solely responsible for ensuring your bots and content do not infringe on third-party intellectual property rights.

7.1 Uptime: While we strive for high availability, we do not guarantee uninterrupted access to VibeBot. Scheduled maintenance and unforeseen issues may cause temporary service disruptions.

7.2 Third-Party Dependencies: Our Service relies on third-party infrastructure (Discord API, Railway, Stripe). We are not liable for outages or issues caused by these providers.

7.3 Support: Support is provided via email at support@vibebot.gg. Response times vary based on subscription tier and issue complexity.

8.1 Termination by You: You may terminate your account at any time by contacting support@vibebot.gg or through your account settings.

8.2 Termination by Us: We reserve the right to suspend or terminate your account immediately if you violate these Terms, engage in prohibited activities, or for any other reason at our sole discretion.

8.3 Effect of Termination: Upon termination, your access to VibeBot will cease, and your bots will be deactivated. We may retain certain data as required by law or for legitimate business purposes.

9.1 AS-IS Service: VIBEBOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEBOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

9.3 Maximum Liability: Our total liability for any claims arising from these Terms or your use of VibeBot shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless VibeBot, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your bots, your violation of these Terms, or your infringement of any third-party rights.

Your use of VibeBot is subject to our Privacy Policy, which explains how we collect, use, and protect your data. By using our Service, you consent to our data practices as described in the Privacy Policy.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use of VibeBot after changes take effect constitutes acceptance of the modified Terms.

13.1 Governing Law: These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

13.2 Dispute Resolution: Any disputes arising from these Terms or your use of VibeBot shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law.

13.3 Class Action Waiver: You agree to resolve disputes individually and waive your right to participate in class action lawsuits or class-wide arbitration.

14.1 Entire Agreement: These Terms, along with our Privacy Policy and other referenced policies, constitute the entire agreement between you and VibeBot.

14.2 Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.

14.3 No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
